Elyr Watches offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. These terms and conditions of sale (hereinafter the "Terms and Conditions" or "T&Cs") apply to any purchase made by an individual (hereinafter the "Customer"), from Elyr Watches.

 

Any new features or tools added to the current store are also subject to the Terms of Use. You can view the most current version of the Terms of Use at any time on this page. We reserve the right to update, modify or replace any part of these TOS by posting updates and/or changes on our website. Your continued use of or access to the website constitutes acceptance of those changes. The Terms and Conditions are accurately dated and may be changed and updated at any time. The applicable Terms and Conditions are those in effect at the time of the Order. Changes to the Terms and Conditions will not apply to Products already purchased.

The present General Conditions of Sale have for vocation to frame the sale and the delivery of the products ordered from Elyr Watches via the site.

Any order placed on the site implies the unreserved acceptance by the customer of these general conditions of sale.

Article 2 - General

The present General Terms and Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, any user of the www.elyrwatches.com website making a purchase via the Elyr Watches website, hereinafter referred to as "the Customer" and, on the other hand, "the Seller", Elyr Watches.

The Customer and the Seller are hereinafter referred to as "the Parties".

These conditions apply exclusively to non-professional individuals.

The acquisition of a Product by this site implies an acceptance without reserve of the General Conditions of Sale.

Insofar as the Customer buys the products on the site www.elyrwatches.com directly and automatically online, the electronic acceptance of the Customer marks the conclusion of the contract between the Customer and the Seller. In accordance with the law of March 13, 2000 on the electronic signature and the law on confidence for the digital economy of June 21, 2004, any purchase validated by the Customer by his "double click" or by his agreement on the telephone constitutes an irrevocable acceptance of these general conditions by the Customer, like a handwritten signature.

The general conditions of sale are concluded for the duration necessary for the sale of the products, until the extinction of their guarantees.

The Customer selects the product(s) he/she wishes to purchase, and can access at any time the summary of his/her order. The Customer has the possibility to modify his order and to correct possible errors before validating it definitively.

The reception of the final payment of the order by Elyr Watches after confirmation of the summary of the order by the Customer concludes the sale contract between the Customer and the seller, the contract can be questioned only within the limits envisaged in the GCS. Any order placed implies unreserved acceptance of the GTC by the Customer.

The confirmation of the order validated by the Customer will be sent by email. Depending on the method of payment used, the sending of the order confirmation may be delayed until the final receipt of payment by Elyr Watches.

To this end, the Customer formally accepts the use of electronic mail for the confirmation by the seller of the content of his order.

Elyr Watches reserves the right to refuse orders from a Customer with whom there is a dispute or incident relating to the payment of a previous order under the conditions detailed in article 4 below.

 

Article 3 - Prices

3.1 The prices are indicated in euros or in converted currency if foreign countries, taxes included.

3.2 The Seller reserves the right to change the price of the items at any time but the items will be invoiced on the basis of the prices in force at the time of the validation of the orders, subject to availability.

3.3 Items and any charges will be billed at the rates in effect at the time the order is placed.

3.4 Retention of title clause: the products remain the property of the Seller until full payment has been received.

 

Article 4 - Order - Validation

4.1 Personal information

At the time of the Order, the Customer agrees to provide the information requested and undertakes to ensure the accuracy of such information:

  • First and last name
  • Mailing address
  • Phone
  • E-mail address
  • The type of payment card, card number, expiration date and cryptogram of the card or PayPal account

Unless proven otherwise, the data recorded by the Seller shall constitute proof of all transactions.

The Customer must verify all the information entered during his order (product ordered, delivery address, billing address, telephone number ...). The Customer must also verify the information on the order confirmation email.

The Seller shall not be held responsible for any data entry errors made by the Customer or for the consequences in terms of delay or error in delivery. Thus, if the delivery cannot take place because of an error of seizure by the Customer, the expenses of forwarding will be the responsibility of the Customer.

4.2 Confirmation and sending emails

The Seller sends an email confirming the Customer's order in order to recapitulate the contractual information.

The Customer's order is then validated by the Seller's services according to the payment validation procedures described in these general terms of sale, the Customer receives a new email informing him of the date of shipment of his order.

4.3 The order established by the Customer is made up of products that are part of the online catalog established by the Seller.

4.4 The order can only be registered on the site if the Customer has clearly identified himself. To do so, the Customer is invited to identify himself by indicating his surname, his first name, a valid e-mail address, his postal address, his telephone number, preferably to contact the delivery person, and his date of birth. The Vendor reserves the right to cancel an order from a Customer who, in its opinion, presents any form of risk or with whom there is a dispute relating to the payment of a previous order.

4.5 Any order implies acceptance of the prices and description of the products available for sale.

4.6 The orders are payable only in euros or in converted currency if foreign countries, all taxes included.

4.7 The Seller undertakes to honour the orders received within the limits of the available stocks of Products.

4.8 The dates of the sales indicated on the site are the dates in force in France.

 

Article 5 - Availability

5.1 The offers of products and prices of the Seller are valid as long as they are visible on the site, within the limits of available stocks.

5.2 For products not available from Seller, Seller's offers are subject to availability from Seller's suppliers/manufacturers.

5.3 In the event that a product is unavailable after the Customer has placed an order, the Seller shall inform the Customer by e-mail as soon as possible. The Customer's order shall be automatically cancelled and the Customer reimbursed under the conditions specified in Article 10.9.

5.4 The availability information provided at the time of the order is given only as an indication because the products are reserved only after the payment of the order. Orders pending payment that are paid late after the order has been registered may thus see the stock of the product(s) ordered modified or nil. In case of stock shortage, the Seller undertakes to contact the supplier/manufacturer to know the delivery time of the ordered product and will inform the Customer immediately.

If the Customer decides to cancel his order for unavailable products, he will be reimbursed for all sums paid for the unavailable products no later than fourteen (14) days following the date on which the contract was denounced.

 

Article 6 - Delivery

6.1 The delivery is made in France, Switzerland, Belgium, Poland, Germany, Czech Republic, Slovakia, Lithuania, Austria, Estonia, Hungary, Luxembourg, Latvia, Netherlands, Denmark, Bulgaria, Croatia, Greece, Italy, Ireland, Finland, Romania, Slovenia, Sweden, Portugal, Spain, Cyprus, Malta, Norway and Andorra. In case of doubt, please inform yourself by e-mail at contact@elyrwatches.com to know the countries available for delivery or details at article 6.

6.2 Zone A: Elyr Watches offers to the Customer the standard delivery costs for an amount higher than 99 euros or equivalent in converted currency and charges the customer €9.90 for delivery for an amount of less than 99 euros or equivalent in converted currency.

Zone B: For Switzerland, Malta, Norway and Andorra, Elyr Watches charges the customer €18.50 for delivery. 

6.3 Elyr Watches or carrier cannot be held responsible for a delay in delivery or non-delivery in the event that the Customer has not indicated a complete and correct delivery address.

  • Delivery method with tracking at home/withdrawal point available:
  • Zone A : standard delivery, free for an amount > 99€ or 9,90€ for an amount < 99€.
  • Zone A : espress delivery, 7€ for an amount > 99€ or > 17€ for an amount < 99€.
  • Zone B : express delivery, at a price of 18,50€ without minimum or maximum amount

The return of a package that could not be delivered due to a lack of information in the delivery address will be charged :

  • 9.90€ to the Customers in zone A for standard delivery
  • 7€ or 17€ to the Customers in zone A, or 18.50€ to the Customers in zone B for express delivery

The delivery time depends on the carrier and the type of product, a period of between 2 and 7 working days is to be expected depending on the country of destination. The possible customs charges are at the charge of the customer.

Elyr Watches is responsible until the Product is delivered to the Customer. It is reminded that the Customer has a period of three (3) days to notify the carrier of any damage or partial loss noted during delivery.

 

6.4 ELYR WATCHES undertakes to respect a preparation time of between 24 and 72 hours for delivery by Colissimo from the positive evaluation of the payment by credit card.

6.5 In case of Products that can be delivered on different dates due to their availability, the delivery time is based on the longest time.

6.6 Upon receipt of the order, the Seller recommends the Customer to check the conformity of the order and to inform the Seller, if necessary, of any anomaly concerning it, within 24 hours. After this period, ELYR WATCHES shall not be liable for any non-conforming delivery.

 

Article 7 - Prerequisites for placing an order

The order of a product by an individual on the site is reserved to persons aged at least 18 years, able to contract and acting for legal purposes.

The Customer guarantees that he/she has sincerely filled in the information requested at the time of registration. Before any use of the site, the Customer must ensure that he has the means

technical and computer skills enabling him to use the site, to order products and that his browser allows a secure access to the Site.

The Customer expressly agrees not to use false information or information from third parties.

After the first order and for subsequent orders, the Customer will be able to access his account by entering his login and password. The Customer is solely responsible for maintaining the confidentiality of his login and password allowing access to his customer account and must take all necessary measures to ensure that these elements remain confidential and secure.

 

Article 8 - Terms of payment - Security

8.1 The payment of the products on line is done by bank card or by PayPal, whose contractual conditions are accessible at the following address: https://www.paypal.com/fr/webapps/mpp/ua/useragreement-full

8.2 The Seller shall make every effort to ensure the confidentiality and security of data. All the data exchanged, and in particular the sensitive data related to the means of payment by card on the web are encrypted by Stripe. The payment is entirely secure.

 

Article 9 - Processing and collection of personal data

The information collected is secured via Shopify. The persons in charge of processing are Charly Davezac and Eris Sadrija. The customer can make a request to Elyr Watches at any time to register on the opposition list to telephone canvassing (BLOCTEL device). Any consumer has the possibility of registering free of charge on the BLOCTEL list of opposition to telephone canvassing https://conso.bloctel.fr/index.php/inscription.php

In accordance with the law n° 2020-901 of July 24, 2020 aiming at framing the telephone canvassing and at fighting against the fraudulent calls, any professional reserves the right to canvass a consumer registered on the list of opposition to the telephone canvassing when it is about solicitations intervening within the framework of the execution of a current contract and having a relationship with the object of the aforementioned contract, including when it is about proposing to the consumer products or services related or complementary to the object of the current contract or likely to improve its performances or its quality. They are kept for the duration of the present relationship and for a maximum of five years after the end of the contractual relationship according to the

legal obligations of archiving and conservation and are intended for contact@elyrwatches.com and its service providers intervening within the framework of the contractual relations between Elyr Watches and the customer.

The Customer may at any time exercise his right of access to his data, have them rectified, deleted, limited, carried, object to their processing or to be the subject of a decision based exclusively on processing, and may give instructions on the processing of his data after his death, by logging into his account or by contacting the customer service contact@elyrwatches.com.

Elyr Watches collects on the site personal data concerning its Customers, in order to process orders placed on the site, to analyze orders, to answer their requests for information and, if the Customer has expressly chosen this option, to send them newsletters, unless the Customer no longer wishes to receive such communications from Elyr Watches. In this respect, the Customer is invited to consult the Privacy Policy which will give him/her more information about the protection of personal data, the processing carried out via the Site and the methods for exercising rights.

 

Article 10 - Guarantees & Right of withdrawal

10.1  Guarantee of conformity

Article L. 217-4 of the French Consumer Code: "The seller delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery.

He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his expense by the contract or has been carried out under his responsibility.

Article L.217-5 of the Consumer Code: "The goods conform to the contract:

1° Whether it is fit for the purpose ordinarily expected of similar property and, if so :

  • if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
  • if it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Elyr Watches is likely to answer for the defects of conformity existing at the time of the delivery and the defects of conformity resulting from the packing, the instructions of assembly or the installation when this one was put at its load or was carried out under its responsibility.

The action resulting from the defect of conformity is prescribed by two (2) years as from the delivery of the Product. (Article L.217-12 of the Consumer Code). In case of lack of conformity, the Customer may request the replacement or refund of the product, at his choice.

In the event that a replacement is not possible, Elyr Watches agrees to refund the price of the Product within thirty (30) days upon receipt of the returned Product and in exchange for the return of the Product by the Customer to the address indicated by email by the customer service contact@elyrwatches.com

The implementation of the legal guarantee of conformity must not entail any costs for the buyer (Article L. 217-11 of the Consumer Code).

10.2   Warranty of hidden defects

The Seller undertakes to exchange or reimburse any Product with hidden defects, defects of conformity resulting from the packaging and quality problems during normal use of the Product, in accordance with Articles L.217-4 to L.217-14 of the Consumer Code.

The costs of reshipment shall then be borne by the Seller. The Buyer may not cancel the sale if the lack of conformity is minor.

Elyr Watches is liable for hidden defects in the product sold that render it unfit for its intended use, or that so diminish this use that the Customer cannot acquired it, or would have given only a lesser price, if he had known them (Article 1641 of the Civil Code)

This guarantee allows the Customer who can prove the existence of a hidden defect to choose between a refund of the price of the product if it is returned and a refund of a part of its price, if the product is not returned.

In the event that a replacement or repair is impossible, Elyr Watches undertakes to refund the price of the product within thirty (30) days upon receipt of the returned product and in exchange for the return of the product by the Customer to the address indicated by e-mail by the customer service contact@elyrwatches.com.

The action resulting from redhibitory defects must be brought by the Customer within two (2) years from the discovery of the defect. (Paragraph 1 of Article 1648 of the Civil Code).

In accordance with the legal provisions in force relating to the conformity of the good to the contract or to hidden defects, the defective products (without it being the fault of the purchaser) or not corresponding to the order will be refunded or exchanged at the choice of the purchaser.

Products must be returned

in the state in which they were received with all the elements (accessories, instructions, protective films...) in a packaging allowing a transport in good conditions.

These guarantees are without prejudice to the right of withdrawal provided in Article 4. It is recalled that under the legal guarantee of conformity, the buyer :

  • has a period of two years from the delivery of the property to act;
  • may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
  • Finally, the Customer is exempted from proving the existence of the product's lack of conformity during the twenty-four (24) months following the delivery of the product except for second-hand goods for which this period is set at six (6) months (Article L. 217-7 of the French Consumer Code).

 

The legal guarantee of conformity applies independently of the commercial guarantee that may cover the product. It is reminded that the buyer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

In all cases, defective products shall be repaired or replaced at no cost to the consumer. This principle of free of charge also applies to the cost of returning the product.

Any return by the Customer involving external postal charges cannot be taken in charge by the Seller if he has not been informed beforehand.

10.3   Commercial quality guarantee

After 24 months from the date of receipt of the order and expiration of the legal warranty, the Seller will provide a repair service according to availability of spare parts for quality problems of the sold watches. However, the customer will be responsible for all expenses related to this service such as shipping costs, replacement parts if necessary and customs taxes.

Quality issues do not apply in the case of :

  • Theft or loss;
  • Intentional damage;
  • Damage resulting from misuse such as scratches, bumps or drops;
  • Normal wear and tear or aging of the materials used;
  • Damage resulting from negligent care;
  • Abnormal use such as exposing the watch to a hostile environment like extremely high or low temperature, unlocked crown, facilitating the penetration of moisture or liquids into the watch;
  • Damage due to exposure to water, chemical substances or liquids such as perfumes, cosmetics or cleaning products.

 

10.4   Order error:

In the event of a model or product error during the preparation of the order, the Seller undertakes to exchange the product. The costs of return and reshipment will be charged to the Seller.

10.5   Return due to the Customer :

The Customer has a legal retraction period of 14 clear days from the date of receipt of the products. The return costs are at the expense of the Customer.

In the event that the Customer has ordered several products via a single order resulting in several deliveries (or in the case of an order for a single product delivered in several batches of parts), the withdrawal period will expire fourteen (14) days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good, the last batch or the last part.


To exercise his right of withdrawal, the Customer must notify his decision to withdraw by means of an unambiguous statement to contact@elyrwatches.com by downloading the withdrawal form available here.

In order for the withdrawal period to be observed, the Customer must send his communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.

In the event of withdrawal by the Customer, Elyr Watches undertakes to reimburse the totality of the sums paid, including delivery costs, without unjustified delay, and at the latest within fourteen (14) days from the date on which it is informed of the Customer's decision to withdraw (Article L.221-24 of the Consumer Code).

Exclusions from the right of withdrawal

The right of withdrawal is excluded in the following cases:

  • Supplies of sealed goods that cannot be returned for reasons of health protection or hygiene and that have been unsealed by the Customer after delivery
  • Provision of services fully performed before the end of the withdrawal period and of which performance has begun after the consumer has given his express prior consent and expressly waived his right of withdrawal
    • Supply of goods or services whose price depends on fluctuations in the financial market
    • Supply of goods made to the customer's specifications or clearly personalized
    • Supply of goods likely to deteriorate or expire rapidly
    • Supply of sealed audio or video recordings or software that have been unsealed after delivery
    • Newspaper, periodical, magazine (except subscription contract)
    • Provision of non-residential accommodation, transportation goods, car rentals, restaurants or services related to leisure activities if the offer includes a specific date or period of performance
    • Supply of goods which by their nature are inseparably mixed with other items
    • Supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only be made after 30 days and the actual value of which depends on market fluctuations beyond the seller's control
    • Supply of digital content not supplied in dematerialized form if performance has begun with the prior express consent of the consumer, who has also acknowledged that he will thereby lose his right of withdrawal

10.6 Upon receipt of the package, the Seller will judge the perfect condition of the products (Product(s), packaging(s), accessories, protective film, notice(s), etc.). No return will be accepted if the products (Product(s), packaging(s), accessories, protective film, notice(s), etc.) returned have been visibly worn, damaged, worn out or deteriorated. The amount of the refund may be reduced in the cases mentioned above, making the products unsuitable for resale in new condition.

10.7 If the return is refused by the Seller, the products will be returned to the customer at the expense of the Seller without the Customer being able to demand a refund or any compensation.

10.8   Exchange:

The Customer has 14 days from the date of receipt to return the products and request an exchange. The return costs will be charged to the Customer. The second delivery will be at the expense of the Customer in case of exchange or repair, at the expense of the Seller in case of order error or application of legal guarantee.

10.9   Refund

In the event that the seller makes a refund of product in the cases referred to in this article, it will be made by mutual agreement via exchange, credit on a future order or according to the method of payment of the customer within 30 days from the date of notification of the refund.

10.10  Credit :

In the event that the buyer wishes to have a credit note, it must be used only on the website within a maximum of 6 months.

Article 12 - Intellectual Property

12.1 All texts, comments, works, illustrations and images reproduced or represented on the site are strictly reserved under copyright and intellectual property law for the entire world.

12.2 For this reason and in accordance with the provisions of the code of the intellectual property, only the use for a private use subject to provisions different even more restrictive from the code of the intellectual property is authorized. Any total or partial reproduction or representation of the site or of all or part of the elements found on the Elyr Watches site is strictly forbidden.

 

Article 13- Liability

13.1 The photos are communicated for illustration purposes only. The Seller invites the Customer to refer to the description of each product to know the precise characteristics.

Elyr Watches undertakes to present the essential characteristics of the products and the mandatory information that the Customer must receive under the applicable law.

These characteristics and information appear on the product sheets on the site. The Customer undertakes to read this information carefully before placing an order on the site.

All the products sold are in conformity with the European legislation in force and the standards applicable in France.

13.2 In the event of hypertext links pointing to other sites from the Seller's site, the Seller shall not be responsible for the content of the information provided on these sites after activation of these links.

13.3 In case of professional purchases, the Seller shall not be liable for any indirect damage due to the present, operating loss, loss of profit, loss of chance, damage or expenses.

 

Article 14 - Comment, Criticism, Communication

You can unsubscribe from our mailings at any time by clicking on the link at the bottom of the page.

All reviews submitted by the Customer are monitored and moderated by the marketing team. If the comments violate the law, morality or ethics (abusive advertising, defamatory comments, insults, comments out of context ...) the Seller reserves the right to refuse or modify the review concerned.

 

Article 15 - Applicable law - Disputes

This contract is subject to French law.

The language of this contract is French.

In case of dispute between the professional and the consumer, they will try to find an amicable solution.

In the absence of an amicable agreement, the consumer has the possibility of seizing free of charge the mediator of consumption to which the professional belongs, namely AME CONSO, within one year as from the written complaint addressed to the professional.

The referral to the Consumer Ombudsman must be made :

Article 16 - After-sales service - Warranty conditions

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects. For any return of parcel, the customer will have to turn over the parcel to Elyr Watches to the address indicated by email by the customer service contact@elyrwatches.com. The Seller undertakes to follow up with the suppliers/manufacturers in case of possible repairs.

Whatever the problem encountered with the product, the customer will have to join a photographic proof / video of the problem by mentioning the number of order, by e-mail to the customer service contact@elyrwatches.com.

All Products sold benefit from the legal guarantees provided by law. The lack of conformity refers to the following situations:

  • Property unfit for the use usually expected of similar property (e.g., product usually intended to operate wirelessly on battery that must eventually be plugged into the mains)
  • Goods that do not correspond to the description given by the seller even if they work perfectly (for example, the color does not correspond to the model presented)
  • Property that does not have the qualities advertised by the seller or agreed with you (for example, an extractor hood presented as particularly quiet turns out to be noisy).
  • Property that has a manufacturing defect, an imperfection, a bad assembly
  • Incorrect installation by the seller or incomplete or incomprehensible installation manual preventing you from mounting the unit properly

Defects can come from:

  • of the good in itself,
  • of the packaging,
  • assembly instructions,
  • the installation when it was made by the seller or carried out under his responsibility.

However, the legal guarantee of conformity does not apply if :

  • you were aware of the defect at the time of purchase,
  • you could not have been unaware of the defect at the time of purchase (for example, if the seller informed you of the defect)
  • the defect is the result of materials supplied or added by you (for example, if you put a non-conforming battery in your phone)

Watch resistance scale:

Water resistance 3 ATM - The watch withstands daily use and light rain.

Water resistance 5 ATM - Cold water bath

Water resistance 10 ATM - Swimming and snorkeling

Water resistance 20 ATM - Scuba diving

The customer acknowledges and agrees that Elyr Watches are fragile and will break if not handled with care.

 

Article 17 - FORCE MAJEURE

Elyr Watches cannot be held responsible if the non-execution or the delay in the execution of one of its obligations described in the present GTC results from a case of force majeure.

 

Force majeure in contractual matters occurs when an event beyond the debtor's control, which could not reasonably have been foreseen at the time of the conclusion of the contract and the effects of which cannot be avoided by appropriate measures, prevents the debtor from performing his obligation.

If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract. If the impediment is definitive, the contract shall be terminated by operation of law and the parties shall be released from their obligations under the conditions provided for in Articles 1351 and 1351-1 of the Civil Code.

 

In the event of the occurrence of one of the above-mentioned events, Elyr Watches will endeavor to inform the Customer as soon as possible.
